The Securities and Exchange Commission (SEC) has recently issued an advisory (as seen below) on WINNERS ECOMMERCE INTERNATIONAL NETWORK CORPORATION, warning the public of the individuals and groups involved in such activities. The advisory defines the activities behind the scheme, and advises the public to not to invest or stop investing in any investment scheme offered by the said entity, its representatives or any entities engaged in schemes which promises ridiculous rates of return with little or no risks.
In support of this view, Coins.ph does not endorse or is affiliated in any way with such activities or products. Moreover, we have a zero tolerance policy on fraudulent activities and potentially scamming practices. In a separate article, we have enumerated tips on how you can avoid investment schemes and other online scams. We urge our customers to be extra diligent with their funds and to act within our User Agreement.
Based on the information gathered by the Commission, a number of individuals or group
of persons claiming to represent WINNERS ECOMMERCE INTERNATIONAL NETWORK
CORPORATION, a.k.a. WINCORP. which is owned and operated by EDWIN BERMUNDO
MORATILLO, a.k.a., WIN BERMUNDO OLINQUINO are enticing the public to invest their money
in said entity.
As posted online, WINCORP. is offering different packages which include the following:
- Gold Package worth Php4,888, with 200 equivalent points;
- Platinum Package worth Php9,888, with 400 equivalent points; and
- Diamond Package worth Php39,998, with 1,600 equivalents points.
A member shall earn Php1,000.00 daily; Php20,000.00 weekly; or even Php30,000.00 or more, monthly.
Below are its ways of earning:
LEVEL 1: Direct Selling
1.1 Online Selling
1.2 Offline Selling
A member shall earn up to 20% or 25% for direct selling either online or offline.
LEVEL 2: Referral Bonus
2.1 Referral Bonus worth Php2,000.00 (gold), Php4,000.00 (platinum), and Php20,000.00 (diamond) of WINCORP’s products shall be given for every members’ direct recruits;
2.2 Efforless Matching Bonus
A member shall earn in accordance with the above table for every matching on the left and right arm of his/her structure for every equivalent points that matched. The sponsor or the upline, however, shall position his/her own direct recruit/s under his/her own existing downline.
2.3 Super Matching Bonus
A member shall earn in accordance with the above table for every matching on the left and right arm of his/her structure for every equivalent points that matched. However, it is the member who shall directly recruits.
2.4 Leadership Bonus
A Diamond Package Member is entitled to earn 2% of the matching bonus of his/her direct recruits up to the 5th level.
LEVEL 3: 10-in-1 Wallet System
A member is entitled to an indefinite commission that shall be credited to his socalled “wallet” (i.e. weekly sales override wallet, yearly savings assistance bonus wallet, medical assistance wallet, fire & burial assistance wallet, utility assistance wallet, car assistance wallet, travel & tour assistance wallet, house & lot assistance wallet, ranking & training assistance wallet, and Wincorp lifestyle assistance wallet), all at the same time, every time any of his downline purchases products regardless of the level of the purchaser.
LEVEL 4: Barangay Business Partner (BBP)1 ; and City Business Partner (CBP)2
A member can have a 5% finders fee whenever he was able to recruit a BBP and CBP.
LEVEL 5: City Sales Marketing Director, Regional Training Director, and National Training Director
These “Directors” shall earn an instant 2% for every CBP purchases.
LEVEL 6: Global Pool Profit Sharing
The top 50 earner of the company within a year will receive Global Sales Shares depending on his/her rank.
To entice the public to join, the company is offering their so-called “Commission Deductions” or (CD) where a prospective member may join the company by availing a gold package without, initially, parting with his money. Instead, the entity shall lend a member an account and the payment to the value of the gold package shall be deducted from the Commissions that may be earned by the member.
Since the above-described scheme involves the sale of securities to the public, the Securities Regulation Code (SRC) requires that these securities are duly registered and that the concerned corporation and/or its agents have appropriate registration and/or license to sell such securities to the public pursuant to Section 8 of the SRC.
Per record of the Commission, contrary to its representation, WINNERS ECOMMERCE INTERNATIONAL NETWORK CORPORATION is NOT registered either as a corporation or a partnership. Having no primary registration/corporate franchise, the more reason that it is NOT AUTHORIZED to solicit investments from the public since it has not secured prior registration and/or license from the Commission as prescribed under Sections 8 and 28 of the SRC.
Hence, those who act as salesmen, brokers, dealers or agents or claim to act as such for WINCORP in selling or convincing people to invest in the investment scheme being offered by said entity including solicitations and recruitment through the internet may be prosecuted and held criminally liable under Section 28 of the SRC and penalized with a maximum fine of Five Million pesos (P5,000,000.00) or penalty of Twenty-one (21) years of imprisonment or both pursuant to Section 73 of the SRC.
Also, those who invite or recruit others to join or invest in such venture or offer investment contracts or securities to the public may incur criminally liability, or otherwise be sanctioned or penalized accordingly as held by the Supreme Court in the case of Securities and Exchange Commission vs. Oudine Santos (G.R. No. 195542, 19 March 2014).
The public is advised NOT TO INVEST or STOP INVESTING in any investment scheme being offered by any individual or group of persons allegedly for or on behalf of WINNERS ECOMMERCE INTERNATIONAL NETWORK CORPORATION and to exercise caution in dealing with any individuals or group of persons soliciting investments for and on behalf of it.
Violators are further warned that aside from the strict penalties imposed by the Commission for violations of the Securities Regulation Code, the Revised Corporation Code, and such other rules and regulation it enforces, the Bayanihan to Heal as One Act (Republic Act No. 11469) also punishes those participating in cyber incidents that make use or take advantage of the current crisis situation to prey on the public through scams, phising, fraudulent emails, or other similar acts.
